The City of San Jose Opportunity to Work Poster informs employees of their right to work additional available hours.

  • Effective March 13, 2017, San Jose employers with 36 or more employees and who are subject to the City’s Business License Tax or who maintain a facility in the City must offer additional work hours to existing qualified part-time employees before hiring new employees or subcontractors, including hiring through the use of temporary staffing services.
  • Employers may not retaliate against employees for exercising their rights under the law.
  • Employees may file a complaint with the San Jose Office of Equality Assurance at the address and telephone number provided on the notice. The City will investigate violations and may order violators to pay penalties.
  • The notice must be posted in any language spoken by at least five percent (5%) of employees at the job site. The Poster is in English, Spanish, Chinese and Vietnamese.
