Employer Responsibilities under the Pasadena, CA Minimum Wage Ordinance

In 2016, the City of Pasadena, California passed the Minimum Wage Ordinance (Muni. Code 5.02) requiring employers to pay their employees at least the minimum wage rate based on the number of workers the employer employed. Beginning July 2021, the minimum wage rate is the same for all employers, regardless of size.  The Pasadena Minimum Wage Ordinance establishes a formula for annual minimum wage rate increases the based upon increases in the Consumer Price Index. Minimum wage rate increases take effect each year on July 1st.

Enforcement Provisions

  • It is unlawful to discriminate in any manner or take adverse action against any person in retaliation for exercising rights protected under Ordinance.
  • Misdemeanor violations are punishable by a $1,000 fine or 6 months imprisonment. Infractions are punishable by a fine.
  • The City or individuals claiming harm from a violation of the Ordinance may bring an action against the employer in court to enforce provisions of the law.

Employee Notice Requirements

Under the Ordinance, every employer must:

  • Post in a clearly visible location where any employee works the Pasadena Minimum Wage Poster that applies to the size of the employer’s workforce to inform employees of the current minimum wage rate that applies to their employment and of their rights under the law.
  • Give to each current employee, and new employees at the time of hire, written notification of the employee’s rights under the Minimum Wage Ordinance and their potential right to the federal Earned Income Credit (EIC).
  • Provide each employee, at the time of hire, the employer’s name, address and telephone number.
  • Document all hours worked by employees and keep records for four (4) years.
