The Virginia Job Safety and Health Protection Poster has been updated to reflect the annual increase in the state’s maximum civil penalty amounts for violations of occupational safety and health standards. Virginia Code § 40.1-49.4 requires the Commissioner of Labor and Industry to adjust the maximum civil penalties for occupational safety and health violations each year by the percentage increase, if any, in the Consumer Price Index. The adjustments to the maximum civil penalties are effective on each August 1. This year, the penalty rates for specified violations have increased to:

  • Serious violations – $13,047
  • Other-than-serious violations – $13,047
  • Failure to correct violations – $13,047
  • Willful or repeated violations – $130,463

The revision date for the notice has been changed to August, 2019.

Posting Requirement

Every employer in Virginia is required to post the 2019 Virginia Job Safety and Health Protection Poster in a conspicuous place where notices to employees are usually posted. (Virginia Administrative Code, Title 16, 25-60-40) “Employer” means any person or entity engaged in business who has employees but does not include the United States. Violations of posting requirements are subject to citation and penalty.
