Kentucky Equal Employment Opportunity Posting Update
The Kentucky Equal Employment Opportunity posting has been updated with information on the new Kentucky Pregnant Workers Act. Effective June 27, 2019, employers with 15 or more employees must make reasonable accommodations for employees related to pregnancy, childbirth or related medical conditions. The posting provides examples of the types of accommodations that may be appropriate. Under the Act, reasonable accommodations include:
- more frequent or longer breaks;
- time off to recover from childbirth;
- acquisition or modification of equipment;
- appropriate seating;
- temporary transfer to a less strenuous or less hazardous position;
- job restructuring;
- light duty;
- modified work schedule; and
- private space that is not a bathroom for expressing breast milk.
Employers will be liable if they fail to make reasonable accommodations for an employee who requests an accommodation for pregnancy, childbirth, or a related medical condition.
Employers, employment agencies, licensing agencies and labor organizations must post the Equal Employment Opportunity posting at their place of business. (104 KAR 1:010) The Kentucky Pregnant Workers Act also requires employers to post a notice that includes information on the right to be fee from discrimination in relation to pregnancy, childbirth, and related medical conditions, including the right to reasonable accommodations.
