On March 9, 2022, Philadelphia’s Promoting Healthy Families and Workplaces Ordinance was amended. Effective until December 31, 2023, employers with 25 or more employees must provide additional paid sick leave to eligible employees when they are unable to work for certain COVID-19 reasons, including:

  • Care for self or family member showing symptoms of COVID-19
  • Care for self or family member exposed to COVID-19 in order to self-isolate
  • Childcare or school closure
  • In order to receive a COVID-19 test, vaccine or recover from injury, disability or illness related to vaccination

Note: “Employee” is defined as an individual (i) working for a covered employer within Philadelphia after the effective date of the Ordinance, (ii) who normally works for the employer within the City of Philadelphia but is currently teleworking from any other location as a result of COVID-19, or (iii) works for the employer from multiple locations or from mobile locations, provided that 51% or more of such employee’s time is present within the City of Philadelphia.

Leave is available for immediate use, and the employee is entitled to use the leave until a week following December 31, 2023. The leave is in addition to all other paid leave benefits an employer provides. An employer cannot reduce the amount of leave it must provide by the amount of paid COVID-19 leave an employee previously received. An employer may not require an employee to use other paid leave available to the employee before the employee is eligible to use COVID-19 leave, unless state or federal law requires otherwise.

Amount of leave:

  • Employees who work 40 or more hours per week receive at least 40 hours, unless their employer provides a greater amount.
  • Employees who work fewer than 40 hours per week receive an amount equal to the amount of time they are scheduled to work or actually work on average in a 7-day period, whichever is greater, unless the employer provides a greater amount.
  • Employees whose weekly schedule varies receive the average number of daily hours that the employee was scheduled over the past 90 days of work, including hours for which the employee took leave of any type, multiplied by 7.

Employees must provide notice to their employers if practicable and as soon as feasible, but only when the need for leave is foreseeable. An employer can request that an employee submit a self-certified statement asserting that leave was taken for a covered reason under the ordinance.

Posting Requirement

Covered employers must provide the COVID-19 Pandemic Paid Sick Leave Notice to each employee.  Employers can satisfy their notice obligations by conspicuously displaying the notice in the workplace. The notice must be sent electronically if employees telework. (Philadelphia Code, Sec. 9-4116(11))
