The Virginia Job Safety and Health Protection Poster has been updated to comply with new regulations governing public employers. Previously, public sector employers – including all departments, agencies, institutions or other political subdivisions of the Commonwealth – were exempt from the penalty provisions of the VOSH law.
A law passed in 2016 required the Virginia Safety and Health Codes Board to pass regulations to apply penalties to public employers for safety and health violations. The new regulations went into effect on November 1, 2018 and will apply to VOSH inspections opened on or after December 1, 2018.
The 2019 Virginia Job Safety and Health Protection Poster now states that public sector employers are subject to the penalty provisions of 16 VAC 25-60-260. The revision date for the notice has been changed to January 2019.
Every employer in Virginia is required to post the 2019 Virginia Job Safety and Health Protection Poster in a conspicuous place where notices to employees are usually posted. (Virginia Administrative Code, Title 16, 25-60-40) “Employer” means any person or entity engaged in business who has employees but does not include the United States.
