San Francisco Minimum Wage, Paid Sick Leave, Consideration of Salary History Poster Description
Minimum Wage
- The San Francisco Minimum Wage Ordinance (Admin. Code Chapter 12R) requires employers to pay covered employees the minimum wage rate for each hour worked within the geographic boundaries of the City. The San Francisco Minimum Wage posting identifies the effective minimum wage rate and notifies employees of the protection from retaliation for exercising rights under the Ordinance. The minimum wage rate is adjusted on an annual basis for the increase in the Consumer Price Index from the preceding year. The new minimum wage rate goes into effect each year beginning on July 1. The Minimum Wage Ordinance covers employees who perform at least two (2) hours per week within City limits, including part-time and temporary employees.
Paid Sick Leave
- The Paid Sick Leave Ordinance (Admin. Code Chapter 12W) requires employers to provide paid sick leave benefits to covered employees for their own illness, injury or medical care or to care for a child, parent, legal guardian or ward, sibling, grandparent, grandchild, spouse or registered domestic partner. The Paid Sick Leave Ordinance covers employees who perform at least two (2) hours per week within City limits, including part-time and temporary employees. The Paid Sick Leave posting describes paid sick leave accrual rates based on employer size, how leave may be provided, permissible uses, and how leave is reported to employees.
Consideration of Salary History
- The Consideration of Salary History Ordinance, a.k.a. Parity in Pay Ordinance (Police Code Art. 33J), prohibits employers from asking about or using a job applicant’s prior salary history in deciding whether to hire the applicant or what salary to offer. The ordinance applies to all employers registered to do business in San Francisco. It covers any occupation, vocation, job or work, including part-time, temporary, seasonal and contracted work. The law does not prohibit salary negotiations or an applicant’s voluntary disclosure of salary history.
Notice & Recordkeeping
- All posters are required to be posted at any workplace or job site where any covered employee works. Each July 1, employers are required to post the official Minimum Wage notice reflecting the current minimum wage rate.
- Notices must be posted in in English, Spanish and Chinese and any other language spoken by more than 5% of the employees at the job site.
- Employers must provide to employees at the time of hire the employer’s name, address and telephone number in writing.
- Employers must maintain payroll records and records documenting hours worked by employees and paid sick leave taken by employees for a period of four (4) years. The amount of paid sick leave must be listed on each paycheck or wage statement.
