The Affordable Care Act Nondiscrimination Notice is a fill-in poster describing the posted provider’s responsibilities under the Affordable Care Act (ACA). There are labeled spaces for mandatory-to-communicate information such as the name of the covered entity, the name and contact information of the Civil Rights Coordinator, and how to access language assistance services.
Pursuant to regulations covering Section 1557 of the ACA, discrimination based on race, color, national origin, sex, age or disability is prohibited in certain healthcare programs and activities. Covered entities must make all provided programs and activities accessible through electronic and information technology for individuals with disabilities.
The poster includes a nondiscrimination statement and tagline notice to alert individuals with limited English proficiency to the availability of language assistance services.
Posting Requirement
The Affordable Care Act Nondiscrimination Notice must be posted in conspicuous physical locations where the covered entity interacts with the public. (45 CFR 92.8 (f)(1)(ii)). Covered entities include:
- Any health program or activity, any part of which receives funding from Department of Health and Human Services
- Any health program that the Department of Health and Human Services itself administers
- Health Insurance Marketplaces and issuers that participate in those Marketplaces
