Mandatory To Post Federal Poster for contractors and subcontractors working on Federal projects, effective June 21, 2010!
Executive Order No. 13496 requires federal contractors and subcontractors to post the new NLRA notice, whether or not they have unionized employees. The rules cover: All prime contracts that are for the purchase, sale, or use of personal property (including off-the-shelf commercially available items) or non-personal services (utilities, insurance, construction, transportation, research, insurance and fund depository.) solicited on or after June 21, 2010, and that are for an amount in excess of $100,000, and all subcontracts, including lower tier subcontracts, that are “necessary” to performance of the federal contract and for an amount in excess of $10,000.
The NLRA poster must be physically posted where other notices are posted, and if the employer also posts electronically, then the NLRA must be electronically posted on the employer’s intranet where such notices are customarily located. Also, where a significant portion of a contractor's or subcontractor's workforce is not proficient in English, they must post the required notice in languages spoken by the employees. Under the new rules, the penalties for non-compliance are severe.
Government Contract Definition. Government Contract means any agreement or modification thereof between any contracting agency and any person for the purchase, sale, or use of personal property or non-personal services. The term "personal property,'' as used in this section, includes supplies, and contracts for the use of real property (such as lease arrangements), unless the contract for the use of real property itself constitutes real property (such as easements). The term "non-personal services'' as used in this section includes, but is not limited to the following services: utilities, construction, transportation, research, insurance, and fund depository. (This includes any banking institution that issues US Savings Bonds in any amount, or is a depository for federal funds in any amount, or maintains deposits protected by FDIC).
