Sunnyvale, CA Minimum Wage Poster Description
Every January 1, the Sunnyvale minimum wage rate is adjusted for inflation corresponding to the prior year’s increase in the Consumer Price Index. The Sunnyvale, CA Minimum Wage Poster informs employees of the effective minimum wage rate. The Minimum Wage Poster also informs employers who are subject to the Sunnyvale Business License Tax or who maintain a facility in Sunnyvale that they must pay the effective minimum wage rate to employees who work two (2) or more hours per week for work performed within city limits. The notice informs employees who assert their rights to receive the City’s minimum wage that they are protected from retaliation and are authorized to file suit against an employer or compliant with the City if they believe they are not being paid for work they have performed and possible remedies.
Enforcement
It is unlawful for an employer to discriminate in any manner or take adverse action against any person in retaliation for exercising protected rights, including:
- the right to file a complaint or inform any person about any party’s alleged noncompliance with the law, and
- the right to inform any person of his or her potential rights and to assist him or her in asserting such rights.
Notice & Recordkeeping
- All covered employers are required to post in a conspicuous place at any workplace or job site where any covered employee works the Sunnyvale Minimum Wage & Know Your Rights posting in all of the following languages: English, Spanish and Chinese.
- Employers must also provide each employee at the time of hire with the employer’s name, address, and telephone number in writing.
- Employers must retain payroll records for a period of four (4) years.
