Hawaii No Smoking Law
In 2006, Hawaii passed legislation requiring places open to the public and workplaces where smoking is prohibited, which includes enclosed and partially enclosed places, to post the Hawaii No Smoking Poster. In 2016, the law was expanded to prohibit smoking electronic cigarettes where smoking is prohibited by law. Clearly legible signs with the words “Smoking Prohibited by Law” or the international No Smoking symbol must be visibly posted at the entrances of every public place and workplace that is designated as non-smoking. (HRS 328J-9).
Places Where Smoking is Prohibited
Smoking is prohibited in enclosed or partially enclosed places open to the public and places of employment, including:
- airports and public transportation;
- public facilities and common areas open to the public;
- entertainment and sporting facilities;
- health clubs;
- educational facilities;
- heath care facilities, medical offices, retirement and nursing homes;
- hotels, motels, and common areas in apartment buildings and condominiums;
- bars and restaurants;
- retail stores and shopping malls;
- private offices;
- any place where the owner, operator, manager, or other person in control of the establishment, facility, or outdoor area has declared that smoking is prohibited throughout the establishment, facility, or outdoor area within their control; and
- within 20 feet of doorways, windows and ventilation intakes.
Violations
Businesses who fail to comply with the law may be fined up to $100 for the first offense, $200 for the second offense within one year of the first violation and up to $500 for each additional violation within one year of the preceding violation. (328J-12).
