Massachusetts Fair Employment Practices Law

Under Chapter 151B of the Massachusetts General Laws, employers with six or more employees are prohibited from discriminating against employees and prospective employees on the basis of protected categories, including:

  • Race (including natural and protective hairstyles)
  • Color
  • Disability
  • Age (40+)
  • Religious Creed
  • Sex
  • Pregnancy/Nursing or other Pregnancy Condition
  • Sexual Orientation
  • Parental Leave
  • Gender Identity/Gender Expression
  • Marital Status
  • National Origin
  • Ancestry
  • Active Military
  • Veteran Status
  • Retaliation
  • Genetic Information
  • Criminal Record

Employers are prohibited from taking adverse action against employees who report or participate in discrimination investigations.

What changed?

The Massachusetts Fair Employment posting has been revised to include the updated Massachusetts Commission Against Discrimination (MCAD) web address. The posting also includes contact information for a new MCAD office location. Individuals who feel they have been harassed or discriminated against must file a claim at one of the three offices listed on the posting.

Posting Requirement

Employers subject to Chapter 151B of the Massachusetts General Laws must display the Massachusetts Fair Employment posting in a conspicuous place or places of their premises.
