What does the Burlingame, California Minimum Wage Ordinance require?
- On September 21, 2020, the Burlingame City Council adopted an Ordinance to establish a minimum wage for all Burlingame businesses beginning January 1, 2021.
- On January 1, 2022 and every year thereafter, the minimum wage will be adjusted based on Consumer Price Index (CPI) percentage increases. A negative CPI will not lower the minimum wage.
Who must be paid the Burlingame, California Minimum Wage Rate?
- Employees who work two or more hours per week within the geographic boundaries of the City of Burlingame are eligible to be paid at least the City minimum wage rate if the business:
- operates within the geographic boundaries of the City of Burlingame
- maintains a facility in the City of Burlingame
- provides good and/or services within the City limits
- Tips and gratuities are not considered a part of the minimum hourly wage rate and may not offset the hourly wage.
- An employer may not use fringe benefits such as health insurance, vacation, sick leave or other benefits to offset or use as a credit towards the employer’s obligation to pay the City minimum wage.
Who must post the Burlingame, California Minimum Wage Poster?
- Covered employers must post the annual Burlingame Minimum Wage Poster prominently in areas of the worksite where it will be seen by all employees. The notice shall be in English and other languages as provided in any implementing regulations.
- Covered employers must give notice to each current employee, and to each new employee at time of hire, of their rights under the Ordinance.
- Covered employers must provide each employee, at the time of hire, with the employer’s name, address, and telephone number in writing.
- Failure to post the Burlingame Minimum Wage Poster constitutes a violation of the Ordinance, codified at Chapter 6.10 of the Burlingame Municipal Code. The City is authorized to impose penalties for violations of the Ordinance.
