Who must post the Cal/OSHA Safety and Health Protection on the Job Peel ‘N Post?
- All California employers are required to post and maintain the California Division of Occupational Safety and Health’s (Cal/OSHA) Notice of Employee Protections and Obligations entitled “Safety and Health Protection on the Job.” (8 CCR § 340).Each employer must post at least one Cal/OSHA Notice in each establishment in a conspicuous place where notices to employees are customarily posted.
- Each employer is required to take steps to insure that Cal/OSHA Notices are not altered, defaced or covered by other material.
- Any employer who fails to post in the workplace any required Cal/OSHA Notice is subject to a fine and/or substantial civil penalty.
Is there new information on the Cal/OSHA posting?
California Labor Code § 6318 requires employers who have received a Cal/OSHA citation, Order, or Special Order to:
- Post the citation or order, or a copy, prominently at or near the place of the violation or unsafe condition for three (3) working days, or until the unsafe condition is corrected, whichever is longer, and
- Post the employee notification that is included with the citation or order in the same location for the same period of time.
The updated Cal/OSHA posting reflects an amendment to Section 6318 effective January 1, 2023. The amendment added the requirement that the employee notification be posted in the top seven non-English languages used by limited-English-proficient adults in California, and also in Punjabi if not included in the list of top seven languages. The Cal/OSHA posting was revised clarifying that an employer must post the multi-language employee notification included with employer citations.
