Product Description

The City of Bloomington Paid Sick Leave Poster provides information on the Earned Sick and Safe Leave Ordinance (ESSL), which requires that employees who work for an employer with five or more employees within the geographic area of Bloomington accrue paid leave to use for medical and safety reasons relating to the employee or the employee’s family member. An employer with less than five employees must allow employees unpaid use of accrued sick and safe time.

Employees who perform work within the geographic bounds of the city for at least 80 hours per year must accrue at least 1 hour of ESSL per 30 hours worked in the city. Employees may not accrue more than 48 hours of sick and safe time in a calendar year, unless the employer agrees to a higher amount. Employees begin accruing ESSL on the first day of employment, or on the day the ordinance goes into effect if they are already employed.

The ESSL must be taken for the following:

  • The employee’s own mental or physical illness, injury, or health condition; including the need to pursue treatment or obtain preventative care.
  • The mental or physical illness, injury or health condition of the employee’s family member, to allow the employee to provide care.
  • An absence due to domestic abuse, sexual assault, or stalking of the employee or the employee’s family member.
  • The closure of the employee’s place of business “by order of a public official” to limit exposure to infectious agents, biological toxins, hazardous materials, or other public health emergencies.
  • To accommodate family member school or daycare closures due to public health emergencies, inclement weather, power outages, or loss of heating or cooling.

Posting Requirement

Every employer resident in the city and employing covered employees is required to display the City of Bloomington Paid Sick Leave Poster in a conspicuous and accessible place in each establishment where covered employees are employed. (Bloomington, MN Code of Ordinances, Sec. 23.09) 

If an employer has employees who speak languages other than English and Spanish, the employer may be required to post the official ESSL poster the City Attorney’s Office deems necessary to inform employees of their rights under the ordinance.
