Who must post the City of South San Francisco, CA Minimum Wage Poster?

The Minimum Wage Law (So. San Francisco Muni. Code, chap. 8.71) applies to employers who are subject to a City Business License and who employ any covered employee. Employers must pay employees covered by the Minimum Wage Law no less than the annual minimum wage rate for each hour worked beginning on January 1.

Who is covered?

The Minimum Wage Law covers employees who perform at least 2 hours of work per week within the geographic boundaries of the City. All covered employees, including tipped employees, must be paid at least the minimum wage rate, except that learners may be paid 85% of the minimum wage rate for the first 160 hours of employment. Employers do not have a tip credit under the law.

How is the minimum wage rate determined?

Beginning January 1, 2021, and each year thereafter, the minimum wage rate will increase by a percentage amount equal to the prior year’s increase in the Consumer Price Index (CPI).  The City of South San Francisco, CA Minimum Wage Poster will be updated every year with the current minimum wage rate. How is the law enforced?

Employees who assert their rights are protected from retaliation. Employees whose rights have been violated may file a lawsuit against their employer or file a complaint the City. Remedies include reinstatement, payment of back wages unlawfully withheld and payment of a civil penalty of $50 to each employee for each day the violation occurred or continued.
