Public Accommodation Discrimination
The New Jersey Law Against Discrimination prohibits discrimination in places of public accommodation based on actual or perceived:
- Race or color;
- Religion or creed;
- National origin, nationality, or ancestry;
- Sex, pregnancy, or breastfeeding;
- Sexual orientation;
- Gender identity or expression;
- Disability;
- Marital status or domestic partnership/civil union status;
- Liability for military service.
Prohibited actions include refusing, withholding, or denying to any person, any of the accommodations, advantages, facilities or privileges of such accommodation on a discriminatory basis. In addition, the New Jersey Law Against Discrimination entitles any person with a disability who uses a service or guide dog to the full and equal enjoyment of all public facilities.
A place of public accommodation is generally any place that offers goods, services, or facilities to the public, including:
- Schools, colleges and universities
- Stores and businesses
- Restaurants
- Summer camps
- Hotels and motels
- Medical providers, hospitals, and doctor’s offices
- Government offices or agencies
Posting Requirements
The owner, lessee, proprietor, manager, superintendent, agent or employee of any public accommodation in New Jersey must display the New Jersey Official Public Accommodation Poster in places visible to all persons seeking or using the accommodations. (N.J.A.C. 13:8-1.4)
