Starting November 1, 2017, the legal age for purchasing tobacco products and electronic smoking devices in the state of New Jersey is 21. A person who violates the law shall be liable to a civil penalty of not less than $250 for the first violation, not less than $500 for the second violation, and $1,000 for the third and each subsequent violation.
Posting Requirements
New Jersey licensed merchants must post the New Jersey Tobacco Proof of Age poster, as a condition of the license, at the point of display of the tobacco products and at the point of sale (New Jersey Stat. 54:40A-4.1). The poster must be at least six inches in size with bold letters at least one-quarter inch high, stating the following:
“A person who sells or offers to sell a tobacco product to a person under 21 years of age shall pay a penalty of up to $1,000 and may be subject to a license suspension or revocation.”
