Pursuant to the San Mateo County Minimum Wage Ordinance (SMCOC 5.158):

  • Employers who maintain a facility located in an unincorporated area of San Mateo County must post at their establishments the San Mateo Minimum Wage Poster to inform employees of the current minimum wage rate, their right to receive the minimum wage, how they are protected under the law, and how to file a complaint if they believe that their employer has violated the law.
  • The San Mateo County Minimum Wage rate applies to San Mateo County employers regardless of the number of employees they employ within the geographic boundaries of the County.

Which employees are covered by the San Mateo County Minimum Wage Law?

  • The minimum wage requirement set forth in the County of San Mateo Minimum Wage Ordinance applies to adult AND minor employees who work two (2) or more hours per week in businesses with a location or locations in unincorporated San Mateo County.
  • All workers in unincorporated areas of San Mateo County, whether or not they are legally authorized to work in the United States must be paid the minimum wage as set forth in the ordinance.
