Texas Identity Theft for Restaurant or Bar Employees Warning Sign

Effective September 1, 2019, a restaurant or bar owner in Texas must display in a prominent place on the premises of the restaurant or bar a sign stating that a person commits an offense if the person obtains, possess, transfer or use a customer’s debit card or credit card number without the customer’s consent or effective consent.

The Texas Identity Theft for Restaurant or Bar Employees Poster warns employees about the fraudulent use of possession of identifying information and provides for a criminal penalty.

Posting Requirement

All restaurant or bar owners that accept credit cards or debit cards from customers in the ordinary course of business must display this specialty poster. (TX Business and Commerce Code, Sec. 502.001(c)) The letters in the poster must be at least one-half inch high, and must be in English and in another language spoken by a substantial portion of the employees of the restaurant or bar. If the restaurant or bar owner fails to comply with the posting requirement, he or she will be committing an offense that may result in a misdemeanor punishable by a fine.
