In addition to the protections enjoyed by all Texans, state law provides special rights and protections for elderly individuals, including anyone 60 and over. The Texas Rights of the Elderly Poster covers the following rights:
- right to dignity and respect;
- right to designate a guardian or representative;
- right to be free from physical and mental abuse;
- right to communicate and complain regarding treatment, care or services;
- right to privacy;
- right to participation in activities;
- right to manage financial affairs;
- right to information and choice regarding medical conditions and care;
- right to keep possessions;
- right to refuse to perform services;
- right to information about benefits;
- right to remain with chosen service provider; and
- rights to make other legal decisions and documents.
Posting Requirement
Per Section 102.004 of the Texas Human Resources Code, an individual, corporation, association, partnership, or other private or public entity providing convalescent and nursing home services, home health services, or alternate care services must display the Texas Rights of the Elderly Poster in a conspicuous location for residents and employees to view.
