Required Update – District of Columbia Minimum Wage Posting

The District of Columbia has updated its mandatory Minimum Wage posting. All employers in the District are required to post this labor law summary. Employers are advised that the District routinely enforces labor law posting compliance and should update posters as soon as possible.

The posting reflects recent changes in the law and procedural changes. Most notably, this year the District of Columbia amended the Minimum Wage Law establishing several incremental increases in the minimum wage rate over the next four years until the minimum wage rate reaches $15.00 per hour by the year 2020. Likewise, the tipped employee minimum wage will eventually rise to $5.00 per hour. The minimum wage rates effective between July 1, 2016 and July 1, 2020 are reflected on the updated Minimum Wage posting.

Another new feature of the posting is information about the use of the internet-based portal to submit quarterly wage reports for tipped employees. Although a hardship exemption can be obtained, most employers are required to use the internet portal to submit reports rather than sending hard copy reports. Some of the other changes to the posting include:

  • A description of the CPI adjustment to the minimum wage rate beginning in 2021,
  • Notice that persons previously excluded from the minimum wage pursuant to the Workforce Investment Act are now excluded pursuant to the Workforce Innovation and Opportunity Act, and
  • Clarification that new hires 18 or older must paid the District’s minimum wage rate immediately upon hire.
