The Kentucky Labor Cabinet has revised the mandatory state Safety and Health on the Job posting to reflect the Occupational Safety and Health Administration (OSHA) anti-retaliation provision. As previously shared on our blog, last May, federal OSHA issued a final rule requiring employers to inform employees of their right to report workplace injuries and illnesses free from retaliation. The rule clarifies that the procedures for reporting work-related injuries and illnesses must be reasonable and not deter or discourage employees from reporting. Employers cannot retaliate against an employee for reporting a work-related injury or illness. Initially, the rule was scheduled to take effect August 10th. Federal OSHA later delayed enforcement to November 1st and finally to December 1, 2016.
The rule requires state-plan states to adopt regulations at least as effective as the federal rule. The Kentucky Safety and Health on the Job posting has been updated with the required anti-retaliation provision.
