West Virginia Division of Labor has released a revised Wage Payment and Collection Act posting. The Wage Payment and Collection Act posting generally describes pay and payment provisions required by law including coverage, deadlines, employee notice and wage assignment requirements.
The posting is updated to reflect new terms made by a 2013 amendment to the Act.
Among the changes is the deadline for final payment of wages to discharged employees. The law now requires employers to pay a discharged employee’s wages in full no later than the next regular payday or four (4) business days, whichever come first. The amendment also requires final payment through normal channels unless the employee requests payment by mail.
Other changes to the posting include clarification of wage assignment rules. These address employee notarization, wage assignment duration and payment limits.
