Pregnancy Discrimination & Accommodation
New Jersey recently enacted legislation prohibiting employers from discriminating against female employees on the basis of pregnancy, childbirth or related medical conditions. The law also requires employers to provide reasonable accommodation to female employees affected by pregnancy or a related medical condition. Reasonable accommodation may include:
- bathroom breaks
- water breaks
- periodic rest
- assistance with manual labor
- job restructuring or modified work schedules
- temporary transfers to less strenuous or hazardous work
An employer may not penalize an employee for requesting or using the accommodation, or for taking medically certified time away from work when accommodation is not feasible. An employer is not required to provide an accommodation that would be an undue hardship on the business operations.
Housing & Public Accommodations
New Jersey law also prohibits discrimination in housing and places of public accommodation on the basis of pregnancy, childbirth or related medical conditions.
