All private employers in the City of Newark, NJ are required to provide employees with up to five days paid sick time off under the City’s new Paid Sick Leave law and to post the City of Newark Paid Sick Leave Ordinance Poster.
Who is eligible for paid sick leave? Employees who work in the City of Newark at least 80 hours in a year.
How much paid sick time must an employer provide?
- Employers with at least 10 employees – Up to 40 hours of paid sick time per year;
- Employers with less than 10 employees – Up to 24 hours of paid sick time per year;
- Child care, home health care and food service workers – Up to 40 hours of paid sick time, regardless of the size of their employer.
What are the permitted uses?
Employees can use their paid sick leave for their own health condition or the health condition of a family member. Permitted uses include:
- Mental or physical illness, injury, or health condition;
- Medical diagnosis, care, or treatment;
- Preventive medical care;
- Business closure due to a public health emergency;
- Child care due to a school closure because of a public health emergency;
- Care for a family member with a communicable disease.
Employer notice & posting obligations
By June 21, 2014, employers are required to provide employees and new hires with written notice of their paid sick leave rights and obligations under the Ordinance. In addition, employers are required to post the newly released Paid Sick Leave Ordinance Poster.
