What is the Crime Victim Leave Law?
The Crime Victim Leave Law:
- amends the state’s Fair Employment Practices Law by adding “crime victim status” to the list of classes protected from employment discrimination and retaliation
- defines “crime victim” to include a person who has obtained an order against abuse, stalking or sexual assault, or who is identified as a crime victim in a law enforcement affidavit
- creates a new crime victim leave protection which provides employees with unpaid, job-protected leave to attend proceedings related to the crime
What must employers do now?
- ensure employees are protected from discrimination based on crime victim status and implement crime victim leave provisions immediately
- ensure employees are informed of their rights by posting the mandatory Employment Protections for Victims of Crime Notice of Employee Rights in the workplace
