Wisconsin Senate Bill 181 was amended, some sections were also newly created, in 2009 with the amended/new sections to be effective 7/5/2010. It now applies to all restaurants, and adds Sports arenas, prisons, mental health institutions, hotels & motels.
The law exempts tobacco retail shops and cigar bars under certain conditions, and also preempts local cities and towns for prohibiting smoking on outdoor areas of private property.
Under the Act, smoking is prohibited in the following enclosed places:
The State Capitol, Residence halls or dormitories owned or operated by a college or university, Day care centers, Educational facilities, Inpatient health care facilities (includes hospitals, county homes and county infirmaries; nursing homes, hospices, the Wisconsin veteran’s home, and treatment facilities), Theaters, Correctional facilities, State institutions, Restaurants, Taverns, Private clubs (a facility used by an organization that limits its membership and is organized for a recreational, fraternal, social, patriotic, political, benevolent, or athletic purpose), Retail establishments, Common areas of multiple unit residential properties, Lodging establishments (a bed and breakfast, hotel, or tourist rooming house), All enclosed places other than those listed above, that are places of employment or public places, Government buildings.
