California Employers Guide Updated for 2011

The California Employers Guide, DE 44 Has Been Updated for 2011

2011 changes for employers in California include:

  • Expanded e-Services for Businesses- Now employers will be able to view and manage their own employer tax account, file most reports, and provide payment options for tax deposits, liabilities and much more. For more information go to https://eddservices.edd.ca.gov.
  • New online tutorial “How to Complete a Payroll Tax Deposit. For more information go to www.edd.ca.gov/Payroll_Taxes/Web_Based_Seminars.htm or call (888) 745-3886.
  • Updated Information Sheet on Limited Liability Entities, available online at www.edd.ca.gov/pdf_pub_ctr/de231llc.pdf. This is a result of the passage of Senate Bill 1244, effective 1/1/2011, which brings EDD into conformity with the Internal Revenue Service guidelines on the tax treatment of Limited Liability Companies (LLC).

In addition, employers will file a Quarterly Contribution Return and Report of Wages (DE 9) on a quarterly basis instead of annually on the Annual Reconciliation Statement (DE 7).

  1. How does an employer discontinue receiving EDD forms if an employee (sole employee) has not worked for the employer since 2009? The employer is now 71 years old and keeps receiving forms from EDD. The employer sent a letter stating he no longer has any employees since 2009. How do we resolve this?


    1. This is perplexing. There is an additional way to contact the EDD. Go online to http://www.edd.ca.gov/About_EDD/Contact_EDD.htm and fill out the “AskEDD” electronic form, or go to http://www.edd.ca.gov/About_EDD/Department_Directory.htm and scroll down to the bottom of the page under “Comments, Suggestions, or Complaints” and click on comments. You will select a topic area and electronically submit your comment. It might be possible that you have to send several mail requests or even direct your request to a department supervisor. We do hope that you are able to resolve this issue.


  2. How do I obtain a copy of the DE , California Employers Guide?


    1. Go to the CA Employment Development Department at http://www.edd.ca.gov/. Direct your cursor over “Employers” (located in the middle of the page). Click on “Reporting Requirements” , then click on (DE 44), the California Employer’s Guide 2012.
