New Jersey has a brand new labor law posting requirement in the works, but it may be a while before we finally get to see it. Recently, New Jersey passed a new Gender Equity law (AB 2647) which requires employers to post and distribute a notice to each worker that details their right to be free of gender inequity or bias in pay, compensation, benefits or other terms or conditions of employment.
The law goes into effect on November 19, 2012, but the law still needs to go through the regulatory process before the “official” Gender Equity notice is released by the NJ Department of Labor and Workforce Development (LWD). LWD tells us that it may take several months.
In addition to the posting and distribution requirements, the law also requires employers to obtain a signed copy from each of their workers acknowledging that the notification has been read and understood.

Who must post and distribute the notice?
- All New Jersey employers with 50 or more employees.
When must employers distribute the notice?
- No later than 30 days after the notice is issued by the LWD, and
- At the time of hiring, and
- Annually (on or before December 31 of each year), and
- Once, at the request of an employee.
Finally, the notice must be posted and distributed in both English and Spanish.
