Time Off To Vote Laws

In just over a week your employees will be voting in the presidential election. As this day draws near employers must evaluate time off to vote laws on a state-by-state basis and take time to review policies for compliance with those laws. Employers are required to know the laws and provide appropriate accommodations.

California and New York even require employers post notices advising employees of voting leave rights. California’s time off to vote notice is included on CPC’s CA All-On-One™ poster. New York’s time off to vote notice is a separate poster which must be posted not less than 10 days before the Election Day.

The majority of states require employers to provide employees time off from their regularly scheduled hours to vote. In general these laws give employees sufficient paid or unpaid time off to visit their polling place on Election Day during their regularly scheduled hours if they are not able to vote before or after work.  Check your state law to determine whether your employees are eligible to take time off to vote and whether their time is paid or unpaid.
