Each year, Colorado’s Constitution requires the state to adjust the minimum wage rate for inflation measured by the Consumer Price Index. This year, Colorado increased the statewide minimum wage rate from $8.00 to $8.23 per hour. The minimum wage rate for tipped employees increased from $4.98 per hour to $5.21 per hour. Both rates are reflected on the updated Colorado Minimum Wage Order 31 Poster.
All employers covered by the Wage Order are required to post the Minimum Wage Order 31 Poster.
Colorado Wage Order 31 applies to private sector employers and employees that perform work in Colorado in the following four industries:
- Retail and Service
- Commercial Support Service
- Food and Beverage
- Health and Medical
The Wage Order does not apply to public sector employers, independent contractors, and certain industries such as construction, manufacturing, and wholesale. An employee covered by Colorado Minimum Wage Order Number 31 or by the minimum wage provisions of the federal Fair Labor Standards Act is entitled to be paid the state minimum wage rate.
