Earlier this year, the Department of Labor (DOL) published a notice announcing that starting January 1, 2018, the Executive Order 13658 minimum wage rate will increase to $10.35 per hour. The executive order generally applies to workers performing work on or in connection with covered contracts. Additionally, the minimum wage rate that must be paid to tipped employees performing work on or in connection with covered contracts will increase to $7.25 per hour. The following types of workers are covered by Executive Order 13658:
- service employees who are entitled to prevailing wages under the Service Contract Act (SCA);
- laborers and mechanics who are entitled to prevailing wages under the Davis-Bacon Act (DBA);
- employees providing support on SCA- or DBA-covered contracts who are entitled to receive the minimum wage under the Fair Labor Standards Act (FLSA); and
- employees working on or in connection with concessions contracts, or contracts for services related to Federal property or land who are entitled to receive the FLSA minimum wage.
The Workers Rights Under Executive Order 13658: Federal Minimum Wage Contractors Poster reflects the updated wage rates that will be effective January 1, 2018. Federal contractors must notify all workers performing on or in connection with a covered contract of the applicable minimum wage rate under the executive order (29 CFR 10.29).
