What’s new?
On July 31, 2024, the Michigan Supreme Court ruled that the Michigan legislature violated the Michigan Constitution when it amended the 2018 adopted initiatives Improved Workforce Opportunity Wage Act and the Earned Sick Time Act. Consequently, the Court calculated inflation-adjusted wage rates and established an effective date for both original acts of February 21, 2025.
Minimum Wage and Overtime
The Minimum Wage and Overtime posting has been revised with the following new minimum wage rates:

Earned Sick Time Act
The posting replaces the Michigan Paid Medical Leave Act posting. Under the Earned Sick Act, all employers must provide every employee with at least 72 hours of sick leave. For small employers (10 or less employees), at least 40 hours must be paid and 32 hours may be unpaid. For all other employers (10 or more employees), all 72 hours must be paid. Employers can require at least seven days’ advance notice for foreseeable paid sick leave.
Who must post?
- Employers subject to the Michigan Improved Workforce Opportunity Wage Act are required to prominently display the Minimum Wage and Overtime posting in a conspicuous and accessible place in each establishment where employees are employed. (MCL, Section 408.417)
- All employers must display the Earned Sick Time Act posting in a conspicuous place that is accessible to employees. (MCL, Section 408.968)
What do you need to do?
You may order now to ensure that all Michigan locations have the new Minimum Wage and Overtime and Earned Sick Time Act postings before the February 21, 2025 effective date.
