What changed?

Changes to Delaware’s mandatory posting requirements include:

  • Creation of the Wage Theft posting describing prohibited actions under the law and penalties for any violations and/or retaliation.
  • Discontinuation of the Employment Discrimination and Workers’ Compensation postings.
  • Addition of a new QR code in the Notice to Employers that directs individuals to the Delaware Department of Labor website.
  • New color scheme and new penalty for any violations of state labor laws.

Who must post?
  • Every employer must post all published summaries of laws and regulations approved by the State Department of Labor in a conspicuous and accessible location in or about the premises or place of employment and where employees normally pass. (19 Del. C. Ch. 9 § 908)
  • Every employer who has 15 or more employees is required to post the Federal Know Your Rights: Workplace Discrimination is Illegal in a place where it can be seen by employees and applicants. (42 USC 2000e-10)
