Who must post the California Personal Rights Residential Care Facilities for the Elderly Poster?
California Code of Regulations (CCR), Title 22, § 84768, requires Residential Care Facilities for the Elderly (RCFEs) licensees to post a notice of the personal rights of residents specified in CCR, Title 22, § 87468.1, Personal Rights of Residents in all Facilities, and CCR, Title 22, § 87468.2, Additional Personal Rights of Residents in Privately Operated Facilities, as applicable to their facilities. CCR, Title 22, § 84768 also requires licensees to post a specified nondiscrimination notice and information about how to file a compliant against the facility. Section 84768 requires this information to be posted in areas accessible to residents, representatives, and the public.
What is a Residential Care Facility for the Elderly?
RCFEs generally serve persons 60 and older. They provide room, board, housekeeping, supervision, and personal care assistance with basic activities like personal hygiene, dressing, eating, and walking. This level of care and supervision is for people who are unable to live by themselves but who do not need 24 hour nursing care. They are considered non-medical facilities. RCFEs must meet care and safety standards set by the State and are licensed and inspected by the Department of Social Services, Community Care Licensing Division (CCLD).
What does the Residential Care Facilities for the Elderly Poster cover?

Section 87468.1 of the poster describes 26 personal rights of residents in RCFEs such as the right to be treated with dignity, the right to have safe, healthful and comfortable accommodations, the freedom to leave the facility, right to personal storage space and personal possessions, the right to keep and spend their own money, the right to have visitors, access to telephones to make and receive confidential calls, to be informed of the procedures for making a complaint against the facility, and certain personal protections afforded residents based on the sexual orientation, gender identity or gender expression of a resident.
2. Section 87468.2
Section 87468.2 of the poster describes 27 additional rights that are protected by law in privately-operated RCFEs, which include the right to privacy in accommodations, medical treatment, records, personal care and communications, the right to make choices in their daily lives, the ability to exercise their rights free from interference, coercion, discrimination, and retaliation, the right to be free from neglect or abuse, the right to facility rates and fees, the right to manage their medical treatment and financial affairs, the right to personal possessions, the right to keep and spend their own money, and the right to make a complaint against the facility.
3. Compliant Information
RCFEs licensees are also required to post pursuant to § 87468(c) contact information for the CCLD and the Long-Term Care Ombudsman. The main hotline number, the crisis line number and the address for the complaint department of the CCLD is provided. Space is also provided so that licensees can fill in the local number and address for the CCLD and LTCO. A web address is provided where licensees may find CCLD and LTCO local contact information.
4. Nondiscrimination statement
RCFEs licensees are required to post the nondiscrimination notice described in § 87468(b)(2)(A) which has been incorporated onto the poster.
