Who must post the California Resident’s Rights Continuing Care Retirement Communities Poster?

The Resident’s Rights Continuing Care Retirement Communities Poster lists the rights of residents’ rights living in California Continuing Care Retirement Communities (CCRCs) under California Health & Safety Code Section 1771.7. What is a CCRC? CCRCs are retirement communities offering a continuum of care for residents 60 years or older, usually for a resident’s lifetime. Independent living, assisted living, and nursing home care are all usually available within a single campus.

What’s covered on the Resident’s Rights Continuing Care Retirement Communities Poster?

Section 1771.7 requires CCRC facilities to post a notice informing residents and visitors that a copy of rights applicable to residents pursuant to Section 1771.1 and any governing regulation issued by the Continuing Care Contracts Branch is available upon request from the CCRC provider. The notice must also state that the residents have the right to file a complaint with the Continuing Care Contracts Branch for any violation of those rights and explain how a compliant may be filed, including the telephone number and address of the Continuing Care Contracts Branch.

The Resident’s Rights Continuing Care Retirement Communities Poster lists the rights of all residents in residential living units. There are nine (9) rights addressing living standards, personal protections, communications, contracts, management of financial affairs, and community participation.  The Poster states the rights of residents to receive a copy of Section 1771.7 rights and right established by regulation from the CCRC provider. The Poster also informs residents of their right to freely exercise all rights without retaliation from the provider. The Poster also provides information about how to file a complaint with the Continuing Care Contracts Branch.

Are CCRCs required to post anything else?

CCRCs are Residential Care Facilities for the Elderly (RCFE) licensees. As a result, CCRCs are required to also post notices required to be posted by RCFEs:
