Who must post the California Rights of Resident Councils Poster?

California Health & Safety Code, Section 1569.157 requires California Residential Care Facilities for the Elderly (RCFE) to post the California Rights of Resident Councils Poster in a prominent place at the facility accessible to residents, family members, and resident representatives. What is a RCFE? RCFEs are Assisted Living or Board and Care facilities serving persons 60 years or older. RCFEs provide room, meals, housekeeping, supervision, storage and distribution of medication, and personal care assistance with basic activities like hygiene, dressing, eating, bathing and transferring. RCFEs are considered non-medical facilities and are not required to have nurses, certified nursing assistants or doctors on staff. RCFEs must meet care and safety standards set by the State and are licensed and inspected by the California Department of Social Services, Community Care Licensing Division (CCLD).

 

What is covered on the California Rights of Resident Councils Poster?

The Poster informs residents of RCFEs of their right to form Resident Councils and have family members and other advocates to participate on Resident Councils. Resident Councils may make recommendations or raise concerns with facility administrators to improve the quality of daily living and care in the facility. RCFE facilities must facilitate the formation of Resident Councils, support the Resident Council and act on recommendations of the Resident Council. Residents must be informed of their right to participate on a Resident Council without reprisal. The penalty for failing to post the Rights of Resident Councils Poster is $250.
