If a day and temporary labor services agency (now referred to as agency) agrees to send a person or group to work as a day or temporary laborer (worker), the agency is required to provide each worker with a statement containing the following list of items on a form: worker’s name, type of work being done, wages offered, the worker’s name and address, terms of transportation, and whether equipment or a meal is provided. The agency should also post this labor law compliance poster in a conspicuous area for employees to view at the workplace.
If the worker is given the same assignment for more than one day, the agency is only required to provide the employment notice on the first day of the assignment, and on any day the terms are changed. If the worker doesn’t receive work one day, if requested, the agency can provide confirmation that the worker sought work for that day. Workers are not to be sent to a place where strikes, lockouts or other labor issues exist. The agency should also hire workers who can communicate these laws to workers in their own language, and post a workplace compliance poster at the agency to ensure that workers are familiar with these laws.
