The New Jersey Department of Labor and Workforce Development, and the Division on Civil Rights have recently updated two mandatory workplace postings. New Jersey employers must update their All-On-One poster to remain compliant. The changes include a new protected class under the New Jersey Law Against Discrimination and corrections to the Employer Obligation to Maintain and Report Records posting.
Earlier this year, before leaving office, Governor Chris Christie signed AB 2294. The law, which became effective January 8, 2018, amends the New Jersey Law Against Discrimination to ban discrimination against breastfeeding employees. Employers cannot refuse to hire, discharge, or discriminate against a breastfeeding employee in compensation and other terms, conditions or privileges of employment. Furthermore, employers are required to provide breastfeeding employees with reasonable accommodations. For example, employers may provide employees with a reasonable break time and a private location to express milk. The Division on Civil Rights has revised the New Jersey Law Prohibits Discrimination in Employment posting to include this new protected class. The posting’s new revision date is 4/8/18. The Division on Civil Rights has also updated the New Jersey Law Prohibits Discrimination in Places of Public Accommodation and the New Jersey Law Prohibits Discrimination in Housing posters to include breastfeeding. All housing and public accommodations are obligated to display these posters in locations visible to all prospective tenants and purchasers, and all persons seeking or using the accommodations. Failure to display the posters is punishable by law.
The Employer Obligation to Maintain and Report Records posting has been revised to correct the Wage Payment Law and Wage and Hour Law recordkeeping obligations. All employers covered by the Wage Payment Law and Wage and Hour Law are required to keep a record of each employee that contains the total hours worked by the employee each day and each workweek. The current version of the posting listed the recordkeeping requirement as a requirement that that did not apply to individuals employed in a bona fide executive, administrative, professional or outside sales capacity. The new posting date is 3/2018.
