How did the Minimum Wage posting change?
The New York Minimum Wage posting has been revised with the new minimum wage rates effective as of December 31, 2019. In New York City, the minimum wage is $15.00 per hour for all size businesses. In Long Island and Westchester counties, the minimum wage is $13.00 per hour. In the remainder of the state, the minimum wage is $11.80 per hour.
The following New York Industry Specific Wage Orders have also been updated with the new minimum wage rates:
All employers who are subject to the Minimum Wage Act are required to prominently display the New York Minimum Wage posting and applicable wage order in a conspicuous and accessible place in each establishment where employees are employed. (Article 19 for the New York State Labor Law, Section 661)
How did the Discrimination posting change?
The New York Discrimination posting has been revised to reflect the following amendments to the Human Rights Law:
  • Effective September 13, 2019, the definition of “pregnancy-related condition” is expanded to include lactation.
  • Effective October 8, 2019, racial discrimination based on natural hair or hairstyles is prohibited.
  • Effective November 18, 2019, victims of domestic violence are a protected class under the law.
  • Effective February 8, 2020, all employers (regardless of number of employees) are covered under the law.
All employers who are subject to the Human Rights Law are required to display the Discrimination posting in easily accessible and well-lighted places customarily frequented by employees and applicants for employment. (New York Code of Rules and Regulations §466.1)
