Illinois’ Required Employment Laws Posting Update Highlights the Illinois 2021 Minimum Wage Increase

2021 Your Rights Under Illinois Employment LawsEarlier this month, the Illinois Department of Labor (IDOL) announced the state’s minimum wage increase going into effect on January 1, 2021. Starting next month, the minimum wage rate increases from $10.00 per hour to $11.00 per hour. The change comes as a result of legislation passed in 2019 incrementally increasing the minimum wage rate until it reaches $15.00 per hour in 2025. The Illinois 2021 minimum wage increase is a welcome boost to the state’s 1.4 million adult hourly workers who currently make less than $15 per hour.

 

In making the announcement, the IDOL acknowledged that employers are fully expected pay the new wage rate. The department also wants to make sure that employees are aware of the $1 increase and should expect to see the increase reflected in their paychecks for work performed in 2021. Tipped employees are also entitled to the minimum wage increase. The law allows tipped employees to be paid 60% of the minimum wage rate. When a tipped employee’s cash wages plus tips do not equal the minimum wage rate, the employer must make up the difference.

 

Minimum wage employees who won’t see the State minimum wage increase are those who work in Cook County or the city of Chicago where minimum wage rates are already higher than $11. In Cook County, the minimum wage rate is $13 per hour. In Chicago, the minimum wage rate for small employers (4 to 20 employees) is $13.50 per hour and the minimum wage rate for large employers (21 or more employees) is $14 per hour.
