What’s new?
Pursuant to Senate Bill 1 (2022), also known as the Healthy Delaware Families Act, employers with 10 or more employees are required to participate in the new Delaware Paid Leave. Effective January 1, 2026, eligible employees may receive up to:
- 12 weeks of paid leave annually to bond with and care for a new child
- 6 weeks in a 24-month period to:
- Address one’s own serious health condition
- Care for a family member with a serious health condition
- Address the impact of a family member’s military deployment
Who must post?
Every employer subject to the Healthy Delaware Families Act must post a paid leave posting in a conspicuous place in or about the premises. (19 Del. C. § 3710) The posting must include the following information:
- The amount of family and medical leave benefits.
- The procedure for filing a claim.
- The right to job protection and benefits.
- That discrimination and retaliatory personnel action against the employee for requesting, applying for, or using family and medical leave benefits is prohibited.
- That the employee has a right to file a complaint for violations of this Act.
- Whether family and medical leave benefits are available through the State or an approved private plan.
