What’s new?
Equal Pay for Equal Work – Changes include:
- § 3-301 defining “posting” and “wage range”
- § 3-304 prohibiting employers from limiting job opportunities and pay differentials based on race, religious beliefs, or sexual orientation
- § 3-304.2 requiring an employer to disclose the wage range and other compensation for a position in job postings, set wage ranges in good faith, protect applicants from retaliation, and keep compliance records for at least 3 years. New MDOL form available.
- § 3-308 providing for enforcement and penalties for violations
Employment Discrimination is Unlawful – Shows the addition of military status to the list of protected classes.
Maryland Occupational Safety and Health Act – Reflects penalty increases for violations of the Act:
- Maximum civil penalty for each violation – $16,131
- Maximum civil penalty for failure to correct on time – $16,131 per day
- Maximum civil penalty for willful or repeat violations – $16,131
- Minimum civil penalty for each willful violation – $11,162
- Annual penalty adjustment beginning July 15, 2025
Wage Payment and Collection Law – Updated § 3-504 requires employers to provide to employees:
- At the time of hire, written notice of the rate of pay, paydays, and leave benefits.
- For each pay period, a written statement that includes specified information. New MDOL form available.
