The Florida Bill of Rights for Residents of Assisted Living Facilities Poster provides information on some of the rights which are guaranteed to residents of assisted living facilities under Florida state law and the Florida and United States Constitutions. The poster also provides contact information for the Florida Long-Term Care Ombudsman Program which provides assistance to residents of assisted living facilities.

Under Florida law, residents of assisted living facilities have specific rights which they must be informed of, including the right to:

  • Live in a safe and decent living environment, free from abuse and neglect;
  • Be treated with consideration and respect;
  • Participate in and benefit from community services and activities and to pursue the highest possible level of independence;
  • Share a room with his or her spouse if both are residents of the facility; and
  • Exercise civil and religious liberties, including the right to independent personal decisions.

Who Must Post the The Florida Bill of Rights for Residents of Assisted Living Facilities Poster?

The Florida Bill of Rights for Residents of Assisted Living Facilities Poster is intended for licensed facilities which provide housing, meals, and one or more personal services for a period exceeding 24 hours to one or more adults who are not relatives of the owner or administrator. The poster is used to let staff, residents, and visitors know that the facility takes the rights of residents seriously and is committed to their care. (Florida Statutes, Section 429.28)

Other Requirements for Florida Residents of Assisted Living Facilities

The facility must also:

  • conduct a survey to determine general compliance with facility standards and compliance with residents’ rights as a prerequisite to initial licensure or licensure renewal;
  • adopt rules for uniform standards and criteria that will be used to determine compliance with facility standards and compliance with residents’ rights; and
  • ensure a resident’s access to a telephone to call the State Long-Term Care Ombudsman Program or local ombudsman council, the Elder Abuse Hotline operated by the Department of Children and Families, and Disability Rights Florida.
