Minnesota Pregnant Workers and New Parents

The poster outlines workplace rights and protections for pregnant workers and new parents in Minnesota. Under the law, employees have the right to request more frequent or longer restroom, food and water breaks, seating, and limits on lifting more than 20 pounds. Employees may also:

  • Receive break times to express milk regardless of their child’s age without losing compensation.
  • Require workplace lactation spaces to be clean, private and secure.
  • Choose when to express milk based on their needs, whether that means expressing milk during an existing paid break, during an existing unpaid break, or during some other time.
  • Take up to 12 weeks of unpaid leave during or following pregnancy.

Pregnancy and parental leave may be taken for:

  • prenatal care;
  • incapacity due to pregnancy or related health conditions;
  • childbirth or adoption; or
  • bonding time by a birthing or non-birthing parent after the birth or adoption of the child.

Employees may also be able to use employer-provided benefits, such as sick leave or disability leave, if the employee is sick during pregnancy or to recover after childbirth.

Posting Requirement

Employers are not required, but are encouraged to display this poster. Employees are required to provide the “Nursing Mothers, Lactating Employees, and Pregnancy Accommodations” notice to new employees at the time of hire as well as when any employee makes an inquiry about or requests parental leave. The notice is included in the Minnesota Mobile Poster Pak and on CPC’s Free Downloads webpage.
