Who must post the Notice of Nondiscrimination Poster?

The Nevada Notice of Nondiscrimination Poster is designed to comply with posting requirements established by NRS §449.101, which apply to a medical facility, facility for the dependent or a facility which is otherwise required to be licensed by the State Board of Health.

 

A “medical facility” includes:

  • A surgical center for ambulatory patients;
  • An obstetric center;
  • An independent center for emergency medical care;
  • An agency to provide nursing in the home;
  • A facility for intermediate care;
  • A facility for skilled nursing;
  • A facility for hospice care;
  • A hospital;
  • A psychiatric hospital;
  • A facility for the treatment of irreversible renal disease;
  • A rural clinic;
  • A nursing pool;
  • A facility for modified medical detoxification;
  • A facility for refractive surgery;
  • A mobile unit; and
  • A community triage center

A “facility for the dependent” includes:

  • A facility for the treatment of alcohol or other substance use disorders;
  • A halfway house for persons recovering from alcohol or other substance use disorders;
  • A facility for the care of adults during the day;
  • A residential facility for groups;
  • An agency to provide personal care services in the home;
  • A facility for transitional living for released offenders;
  • A home for individual residential care;
  • A peer support recovery organization;
  • A community health worker pool; and
  • A provider of community-based living arrangement services.

What is prohibited?

The law provides that a medical facility, facility for the dependent or facility which is required to be licensed by the State Board of Health, and any employee or independent contractor of such a facility, may not discriminate in the admission of, or the provision of services to, a patient or resident based wholly or partially on the actual or perceived race, color, religion, national origin, ancestry, age, gender, physical or mental disability, sexual orientation, gender identity or expression or HIV status of the patient or resident or any person with whom the patient or resident associates.

 

The State requires licensed facilities to post prominently in the facility the nondiscrimination statement featured on the Notice of Nondiscrimination Poster providing that the facility does not discriminate or permit discrimination, including with limitation, bullying, abuse or harassment on the basis of an individual’s actual or perceived inclusion within a protected category. A space is provided to write in the name of the facility. In addition, the Notice of Nondiscrimination Poster includes a statement that a patient or resident who has experienced prohibited discrimination may file a complaint and provides contact information for the Nevada Department of Health and Human Services, Division of Public and Behavioral Health.
