Under Section 202-j of the New York Labor Law, employers with more than 20 employees must grant three hours leave in any 12 month period to any employee who works twenty or more hours per week and seeks to donate blood.

Posting Requirements

Employers must notify employees in writing of their right to take blood donation leave. Such notification must be made in a manner that will ensure all employees see it, such as displaying the New York Blood Donation poster in a prominent spot in an area where employees congregate. If the employer provides written notice to each employee, it shall do so at the time of hire to new employees, and thereafter, to all employees on an annual basis, no later than the 15th day of January.
