Sale of cigarettes, cigars, chewing tobacco, powdered tobacco, shisha or other tobacco products, herbal cigarettes, liquid nicotine, electronic cigarettes, rolling papers or smoking paraphernalia to minors is prohibited in the state of New York.
Penalties for illegal sales to minors include fines, loss of license to sell lottery tickets and loss of license to sell tobacco products.
Posting Requirements
Businesses where tobacco products are sold must display the New York Sale of Tobacco Products poster in a conspicuous place. The poster must contain the following text:
“Sale of cigarettes, cigars, chewing tobacco, powdered tobacco, shisha or other tobacco products, herbal cigarettes, liquid nicotine, electronic cigarettes, rolling papers or smoking paraphernalia, to persons under twenty-one years of age is prohibited by law.”
The text shall be printed on a white card in red letters at least one-half inch in height.
