Who must post the Washington State 2024 Paid Time Off posting?

Washington State Paid Family and Medical Leave Insurance Law (“Paid Time Off”) (RCW 50A.20.020) requires all Washington employers to post and keep posted, in conspicuous places on the premises of the employer where notices to employees and applicants for employment are customarily posted, the Washington State 2024 Paid Time Off posting. State regulations advise that the Paid Time Off posting should be displayed in a common area, such as a break room or other area where such notices are customarily posted. (WAC 192-540-020).

What’s new?

Under the Paid Time Off Law, eligible employees can take up to 12 weeks (or longer) of family and medical leave for:

  • a serious health condition that prevents them from working;
  • to care for a family member or a new child; or
  • for certain military-related events.

During the period of leave, employees can receive up to 90% of their typical weekly pay, up to the maximum weekly benefit amount established for that year. Each year, the Commissioner adjusts the maximum weekly benefit amount to 90% of the state average weekly wage. The Paid Time Off posting has been updated to reflect the maximum weekly benefit amount for the 2024 calendar year, the annually-adjusted premium rate, and percentage that is the employee’s contribution. The weekly benefit amount is effective as of January 1, 2024.

What are the law’s recordkeeping and enforcement provisions?

  • Employers are required to keep records pertaining to Paid Time Off for a period of 6 years. Information obtained from employer records is confidential and not open to public inspection, other than public employees in performance of their official duties.
  • Failure to post the Washington State 2024 Paid Time Off posting may result in a penalty of $100.00 for each instance an employer has willfully failed to comply with the posting requirement. (WAC 192-540-020).
